Huntsville Defective Product Lawyers

From the laundry detergent pods you grab at Publix to the latest riding lawn mower available at Home Depot, you expect the products you bring into your home to be safe. You presume that when you use the product as it is intended to be used, you and your family will not be harmed. Unfortunately, that is not always the case. Many products make it online or to the store without being as safe as they should be. These defective products put you and other members of your household at risk for injury.

Types of Defects

Not all defective products malfunction in the same way. There are three main categories of defects that may cause harm:

  • Design defect- If a product is not put together in such a way that makes it as safe as possible, then that product poses a risk of harm to consumers.
  • Manufacturing defect- A product may be appropriately designed, but something may go wrong during the manufacturing process. If an error arises during the assembly of a product, then that product becomes hazardous.
  • Warning defects- Some products have inherent dangers no matter how safely they are designed. For instance, many power tools may be relatively safe when used properly and cautiously. However, they clearly pose certain safety risks that the user must be aware of. That is why these types of products come with warning labels.

Theories of Liability for Defective Product Claims

During most personal injury claims, the theory of liability is negligence. You are attempting to prove that another party was negligent and that this behavior caused your injuries. For defective product claims, there are four potential types of liability you may use to claim the other person is liable for compensating you for your injuries:

  • Negligence- Under a theory of negligence, you claim that the other party had a duty of care toward you and acted carelessly. This breach of their duty led to a defect that the other party could have foreseen would cause you harm.
  • Misrepresentation- Under a theory of misrepresentation, you claim that you relied on the other party’s information regarding how to use the product safely. If the manufacturer’s or other party’s information was misleading or false, and this caused you to get hurt, then you may be able to recover compensation.
  • Breach of warranty- Warranties are implied or direct promises. Under a theory of breach of warranty, you claim that the other party made a promise to you in some way about the product. If the product did not live up to the other party’s promises, resulting in your injury, you may pursue compensation.
  • Strict liability- In some circumstances, a manufacturer or other party is entirely responsible for the quality of a product and any injuries it causes. If strict liability applies to your case, you do not have to prove that the other party was negligent or did anything particularly wrong. You only have to prove the product caused your injury in order to show the other party is liable for compensating you.

Product Liability Claim Compensation

When you are injured by a defective product as the result of a manufacturer, retailer, or other business’s actions, our Huntsville defective product lawyers can help you pursue a variety of compensation. In a product liability claim, you can seek compensation for:

  • Medical costs
  • Loss of earning capacity
  • Property damage

  • Mental anguish
  • Loss of enjoyment of life
