Types of Defects

Not all defective products malfunction in the same way. There are three main categories of defects that may cause harm:

However, they clearly pose certain safety risks that the user must be aware of. That is why these types of products come with warning labels.

Theories of Liability for Defective Product Claims

During most personal injury claims, the theory of liability is negligence. You are attempting to prove that another party was negligent and that this behavior caused your injuries. For defective product claims, there are four potential types of liability you may use to claim the other person is liable for compensating you for your injuries:

  • Negligence- Under a theory of negligence, you claim that the other party had a duty of care toward you and acted carelessly. This breach of their duty led to a defect that the other party could have foreseen would cause you harm.
  • Misrepresentation- Under a theory of misrepresentation, you claim that you relied on the other party’s information regarding how to use the product safely.
